SUBJECT

The purpose of these general terms and conditions of sale is to govern the contractual relationship between Cannes Fayet®S.E and the customer, defined below as the user of the site who accepts these General Terms and Conditions of Sale.

Consequently, any order placed implies full acceptance of these General Terms and Conditions of Sale. All other conditions are non-binding. PRODUCTS

The items we sell are described, presented and photographed with the utmost accuracy. Should an error occur despite our best efforts,Cannes Fayet®SE cannot be held responsible.

VALIDITY PERIOD OF SALES OFFERS

Products are offered for sale while stocks last. For products not in stock in our warehouse, our offers are subject to availability from our suppliers. In the event of an order for an unavailable product, the customer will be informed by email as soon as possible.

PRODUCT PRICING

The prices shown on the site Cannes Fayet®S.E prices are in Euros and include all taxes, excluding shipping. They may be modified at any time without notice. To this price must be added shipping costs calculated according to the type of items ordered. Shipping costs are specified on the screen at the end of the customer’s selection of the various products, and are recalled in the order summary that precedes validation.

The price is payable in cash on the day the order is placed. Prices are those applied at the time of order, subject to stock availability and to typographical errors or changes in the French VAT rate (or changes in company status). Any change in this rate would then be immediately reflected in sales prices.

Outside the European Union or in French overseas departments and territories, and depending on the legislation in force in the delivery zone, customs duties and taxes may be claimed by the latter from the customer.

ORDERS

If the customer wishes to place an order, he must first identify himself. To this end, he/she will fill in a form, according to the indications provided online, in which he/she will enter the information necessary for his/her identification and in particular his/her surname, first name, telephone number, postal and e-mail addresses, billing and delivery addresses. Additional information may subsequently be requested to ensure the quality and safety of the delivery. All information is presented to the customer in French.

Once the customer has chosen the products presented, he/she will confirm his/her order by clicking on the “Confirm order” button to confirm his/her commitment and acceptance of the General Terms and Conditions of Sale. From this moment, the order is recorded and a confirmation is communicated to the customer on screen and/or by e-mail. The data recorded by Cannes Fayet®S.E constitute proof of the nature, content and date of the order.

No unilateral cancellation of an order will be accepted without the agreement of Cannes Fayet®S.E. . If, despite everything, the customer cancels his order, the cancellation will give rise to an indemnity fixed at 10% of the amount inclusive of tax of the order and to the acquisition of the deposits paid.

ORDER SWORDS :

Acquisition authorized for adults.

Minors over the age of 16 are required to present a valid hunting license, or a sports license for edged weapons, and parental authorization.

According to decree no. 2011-618 of May 31, 2011, sales to minors are prohibited.

CANE AND UMBRELLA REGULATIONS:

The sword cane and sword umbrella is a category D weapon, and in France carrying it is prohibited. For foreign countries, be sure to check your country’s legislation.

Please note that under European law, any customs authority in a transit country has the power to stop the package for inspection. If the goods are seized by customs, we will not be held responsible.

DELIVERY METHOD

Delivery is made to the address specified by the customer when placing the order.

Parcels can be delivered by Chrono Relais, Colissimo (Groupe la Poste) or DPD, home delivery by appointment or by Chrono Relais to the retailer of your choice.

Deliveries over €59, and measuring less than 1 meter can be shipped free of charge to a Point Relais (in France).

If an item is temporarily out of stock, it will be automatically dispatched as soon as it is restocked.

Delivery can only take place once the order has been validated by the customer and payment has been made in full. Any bank payment centers concerned will therefore have given their prior approval for payment. In the event of refusal by the said centers, the order will be automatically cancelled.

Furthermore, Cannes Fayet®S.E reserves the right to refuse any order from a customer with whom there is an ongoing dispute.

Delivery to a parcel delivery point: the parcel must be collected within 10 days, after which time the parcel delivery point returns the parcel to the sender. Cannes Fayet® will be billed €16.50 for returns, which may be recharged to the customer, as well as shipping costs.

Delivery outside France, outside Europe: Prices exclude taxes and customs duties.

DELIVERY TIME

Delivery times may vary according to product availability. This can vary very quickly depending on the level of sales. The maximum delivery time is 10 working days. The legal delivery period is 30 days.

In the event of force majeure or exceptional events (natural disasters, epidemics, strikes, lock-outs, etc.) delaying or prohibiting the delivery of goods, Cannes Fayet®S.E accepts no liability whatsoever. In all cases, on-time delivery is only possible if the customer is up to date with his obligations to Cannes Fayet®S.E
Cannes Fayet®S.E cannot be held responsible for stock variations and therefore stock availability.

CLAIM

We remind you that, in accordance with current legislation, goods travel at the recipient’s risk, even if shipped carriage paid. The customer is obliged to check the conformity and good condition of the goods on delivery. It is the customer’s responsibility to make all reservations with the carriers and to exercise any recourse against third parties. Cannes Fayet®S.E accepts no responsibility for damage, breakage, deterioration or loss during transport.

All claims relating to a defect in the goods delivered, an inaccuracy in the quantities or an erroneous reference in relation to the order confirmed by Cannes Fayet®S.E, must be made in writing within three days of receipt of the goods, failing which the right to complain will cease to exist. All returns require the prior agreement of Cannes Fayet®S.E . In the absence of agreement, any returned goods will be held at the customer’s disposal at the customer’s expense, risk and peril, with all transport, storage and handling costs to be borne by the customer. In all cases, goods are returned at the Customer’s expense and risk. Cannes Fayet® cannot under any circumstances be required to compensate or cancel an order following the impossibility of using the product purchased for reasons of incompatibility with equipment already owned by the Customer.

MODE OF PAYMENT

The customer has the following methods of payment:

– payment by credit card

– payment by Paypal

– payment by bank transfer

Customers can order from boutique-cannes-fayet.com. He will then send his payment by post, together with his first and last name, the number and details of his order, to the address shown on the cover page of the catalog.

The customer’s account is debited with the amount of the products and shipping costs as soon as the order is prepared.

WARRANTY AND AFTER-SALES SERVICE

This warranty does not cover damage resulting from accidents, misuse or neglect. Depending on the product and the date of purchase, repairs will be carried out either by Cannes Fayet®S.E, or by the manufacturer directly. In the event of the return of non-defective material, the customer may be invoiced for transport, handling and testing costs.

Any return of goods requires the prior agreement of Cannes Fayet®S.E and obtain a return number issued by the latter to the customer, which must be clearly written on any returned package. Goods are returned at the customer’s expense and risk. Products returned by carrier without physical protection or poorly protected will not benefit from the warranty. It is therefore the customer’s responsibility to protect and insure the returned product(s) during transport.

It is the customer’s responsibility to keep all packaging and accessories supplied with the product, as well as any labels affixed to the product or its packaging, which are necessary to benefit from the warranty offered.

Cannes Fayet®S.E will apply the warranty to any product returned as soon as possible. What’s more, the after-sales service provided by Cannes Fayet®S.E will select the carrier responsible for delivering the goods to the customer.

Total satisfaction guarantee

Cannes Fayet®S.E If, for any reason whatsoever, the customer is not completely satisfied with one of our products, he may return it. From the date of delivery of his order, the customer has a period of 14 days to exercise his right of withdrawal, and be reimbursed. However, products that are incomplete, worn, damaged or soiled will not be taken back. Special orders: and cane cut to length will not be accepted.

Additional handling, testing and repackaging charges may apply.

RETENTION OF TITLE AND LIABILITY

Boutique-cannes-fayet.com retains ownership of the goods until full payment has been received from the customer. Ownership of the products is transferred to the customer upon full payment of the price. However, during the period between delivery and transfer of ownership, the risks of loss, theft or destruction are borne by the customer.

Failure by the customer to meet its payment obligations, for whatever reason, gives Cannes Fayet®S.E the right to demand the immediate return of the goods delivered at the customer’s expense and risk.

DATA CONFIDENTIALITY

All information provided by the customer during visits to the Cannes Fayet®S.E website is strictly confidential.

Under no circumstances will contact information be transferred, sold or rented other than to make a delivery or to respond to an injunction from the legal authorities.

The information provided by the customer will be used exclusively by our services.

Their objectives are to:
– complete the purchasing process, from order taking to delivery
– to improve our services for greater customer satisfaction. In accordance with the French Data Protection Act, customers have the right to access, rectify and delete their personal data.

ATTRIBUTION OF JURISDICTION

The contractual information is presented in French and the products offered for sale comply with French regulations. Where applicable, it is the foreign customer’s responsibility to check with local authorities regarding the use of the product he/she intends to order. Cannes Fayet®S.E cannot be held liable for failure to comply with the regulations of a foreign country.

The relationship between Cannes Fayet®S.E and the customer are governed exclusively by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Please contact our customer service department. Failing an amicable solution, any legal action will be brought before the competent courts. These provisions do not exclude customers domiciled outside France from the application of the rules set out in international agreements.

The contractual place of performance is the company’s registered office. Cannes Fayet®S.E. The place of jurisdiction is Thiers. The customer’s general terms and conditions of purchase cannot be set against these general terms and conditions of sale.
